How this Privacy Notice Applies to You

This general privacy notice (“Notice”) describes how Klas Limited and its subsidiaries (collectively “Klas”) may Use Personal Data about you when you interact with our company through various channels; the acquisition and use of Klas products and services, accessing the Klas website, platforms, processes, applications, events; and engaging in business dealings with us (“Channels”). This Notice also informs you about your privacy rights and the measures and processes we put in place to protect your Personal Data. Klas is committed to protecting the privacy and security of your Personal Data.

For the purpose of this Notice, “Personal Data” is data, or a combination of data, from one or more sources, that identifies or could reasonably be used to identify an individual. In this Notice, we refer to you as “you” or “your”. We use the term “Use” when we refer to the access, collection, recording, organization, structuring, retrieval, disclosure, storage, transfer, deletion or otherwise use of your Personal Data.

This Notice applies whether you are a customer, visitor, supplier or business partner, job applicant, or any other individual with whom we engage or who is involved in our business activities. Klas operates as a product and service provider for business-to-business transactions. Our collection and processing of Personal Data are primarily confined to instances where it is necessary to facilitate business dealings, and at the request or direction of our customers, suppliers or business partners.

The information that we Use about you may include various categories of Personal Data depending on your interactions with Klas, third parties with whom we collaborate, or external sources that provide us with your Personal Data.  We have outlined below the main categories of Personal Data.

access to certain Klas web pages, services, products or online activities may require that you create, or are provided with, a ‘log-on’. It is your responsibility to maintain the confidentiality of your login username and password information.

Voluntarily Disclosed Information

any information you provide to us through web forms or other communication tools available to you while engaging with Klas.

Resume Information

education and/or employment history, skills, background checks, certifications.

Data from social media activities and monitoring

social media is included in our Channels to share important news about our products and business activities. When monitoring these particular Channels, we may receive aggregate information or access Personal Data about you, such as your username, profile, and what you say, like or comment on our Channel;

  

Identification Data

Name, company and photo taken (when accessing  certain Klas premises) or Anti Money laundering compliance.

Where we rely on ‘legitimate interests’ as a legal basis for processing above, please note that we will not process your Personal Data for these purposes if our or the third party’s legitimate interests should be overridden by your own interests or fundamental rights and freedoms.

Where do we get your information from?

In most cases, Klas will collect information directly from you, although sometimes we will obtain information from public or third-party information sources, such as from marketing/social media platforms such as LinkedIn and Google or in other contexts made apparent to you at the time.

Cookies and Analytics

Klas, as well as our service providers (including web analytics companies and other third parties), Uses cookies, web beacons, and similar technologies to automatically collect certain information—including Personal Data—from your computer or mobile device over time and across different websites, as further described in our Cookies Policy

Disclosure of Information

We may disclose your Personal Data to third party recipients in connection with the above purposes, including:

  • to third parties who we engage to provide services to us, such as outsourced service providers, IT services providers, professional advisers and auditors;
  • to other members of Klas’ group or affiliates;
  • to business partners of Klas (and their agents and professional advisors);
  • to third parties, their agents and professional advisers, subject to confidentiality obligations, for the purpose of a due diligence exercise by third parties in connection with any proposed merger, acquisition, re-organisation or transfer of our business and to any person proposing to participate in, or promote or underwrite or manage any such arrangement; and
  • to competent regulatory authorities and other bodies as requested or required by law.

Transfer of your Personal Data to Other Countries

In accordance with applicable law, Personal Data covered by this Notice may be transferred to, and processed and stored in, the United States or Australia or any other country in which Klas or its affiliates, subsidiaries, service providers, business partners, or customers maintain facilities, even if the level of data protection required in that country differs from that required within the European Economic Area. If and to the extent that we make further transfers, we will ensure that appropriate measures are in place to comply with our obligations under applicable law governing such transfers, which may include entering into a contract governing the transfer which contains the ‘standard contractual clauses’ approved for this purpose by the European Commission.  In addition, Personal Data may be transferred to the United Kingdom based on the adequacy decision adopted by the European Commission.

Links to Third Party Websites

The Klas website may from time to time contain links to and from third party websites, some of which may be co-branded with the Klas logos. These websites are not operated or maintained by Klas and Klas does not share your Personal Data with such sites. If you follow a link to any of these sites please note that Klas does not accept any responsibility or liability for the privacy statements or privacy practices of such third parties. Although we choose our business partners carefully, your use of their websites is entirely at your own risk. Once you have left our website you should make a practice of checking the relevant privacy notice of the third-party website in order to determine how they will use the information they collect from you.

Retention Period

We will retain your Personal Data for the period necessary to fulfill the purposes outlined in this Notice.  The criteria used to determine such retention periods include: (i) the length of time we have an ongoing relationship with you; (ii) whether there is a legal or business obligation to which we are subject; or (iii) whether a longer retention period is required or permitted by law, for example to maintain certain contractual or tax records.

Your Choices and Rights

Your Rights

Every visitor to our Channels has the following rights:

Access.  You have the right to request that Klas provide you with copies of your Personal Data, together with other information about our processing of that Personal Data.

Rectification.  You have the right to request that Klas correct any information that you believe is inaccurate or complete information about you that you believe is incomplete.

Erasure.  You have the right to request that Klas erase your Personal Data, under certain conditions.

Restriction.  You have the right to request that Klas restrict the Use of your Personal Data, under certain conditions.

Objection.  You have the right to object to Klas’ Use of your Personal Data, under certain conditions.

Data Portability.  You have the right to request that Klas transfer the data that we collected to a third party, or directly to you, under certain conditions.

Please note that these rights are not absolute, and are subject to certain restrictions and exemptions.  For example, the right to erasure of personal data will not apply where we have a legitimate reason to continue to hold such data.
